TERMS AND CONDITIONS

                The users of “pfplace” social network must accept the following Terms and Conditions. These Terms and Conditions govern relations of “pfplace” with users, and are a contract between both parts.

1.- Registration

All users must provide their real names and information. The user agrees to:

                a) Not distort personal information of his or her data.

                b) Not create accounts for other people without their consent.

                c) Not use the personal profile of others to obtain commercial benefits.

                d) Only those over 14 years old may register and use the services of “pfplace”.

                e) Maintain the contact information updated.

                f) Not do anything that might harm the privacy of your data or any other user's data.

                g) Not transfer the registered account without written consent from “pfplace”.

2.- Approval of the Terms and Conditions

When the user registers, he or she agrees that has read, understood and accepted these Terms and Conditions. If he or she disagrees with them, he or she may stop using “pfplace” at any time.

3.- Legal persons

If the user registers on behalf of a juristic person, society or nonprofit organization, he or she must be able to represent it and compromise in its name.

4.- Benefits of creating an own social network

“pfplace” will facilitate users to create and administrate their own social network.

5.- Taxes

The user is solely responsible for the payment of taxes or other expenses that he or she may be charged for hiring any of the advertised services on “pfplace”.

6.- Exposed contents rights

The user is the sole owner and proprietor of the rights of any content he or she may expose in “pfplace”, unless specific agreements made with “pfplace”.

However, the user is the sole responsible of owning the rights of exposed contents in “pfplace”. Likewise, the user is solely responsible for the illicit use of any content exposed in “pfplace”, assuming any type of claim or indemnity that such event could produce.

7.- Right to convey suggestions

The user has the right to convey to “pfplace” suggestions, ideas, recommendations or comments to improve service. All rights to exploit such suggestions, ideas, recommendations or comments are owned by “pfplace”, without the user being able to demand compensation or royalty for it.

8.- Protection of third parties' rights

The user compromises to respect the rights of third parties. Therefore, the user:

                a) Will not violate laws in any way.

                b) Will not publish contents nor execute actions that might harm others.

                c) Will not collect data from third party users without their consent. In any case, it is established the exclusive responsibility of the user that collects such data.

                d) Will not publish identification or financial data of other users.

“pfplace” may remove any content that violates the third parties' rights. Likewise, “pfplace” may close the account to who infringes the rights of third parties.

9.- Proper use and behavior

The user is solely responsible for the use of “pfplace” and for the behavior that he or she maintains in its use. Any illegal or dangerous use of “pfplace” will be the sole responsibility of the user.

Therefore, the user can not use “pfplace” in the following ways:

-infringing or violating the rights of third parties regarding their intellectual property rights or any other property or contractual right.

-introducing virus or causing destruction, limitation or interruption of any software, hardware or telecommunication equipment.

-promoting spam, chain letters or pyramid structures.

-promoting illegal or fraudulent activities, including phishing or the obtaining of personal or financial data.

-spreading slanders, threats or violence against any natural or legal person.

-invading the privacy of third parties.

-harming in any way minors' rights.

-undermining the people's rights or causing violence, hatred or discrimination against people for their race, color, sex, religion, nationality, ethnic or national origin, disability or handicap, age, sexual orientation or any other type of discrimination.

-impersonate a “pfplace” employee or any other person for illicit or immoral purposes.

-disrupt or damage the activity of “pfplace”.

-using manual or mechanical procedures to copy contents or procedures of “pfplace”.

10.- Copyright protection

Users may not use copyrights or trademarks of “pfplace”, nor other similar or confusing brand without the written consent of “pfplace”.

Also, users may not use or promote “pfplace” names or logos in any media. They may do so in personal invitations to people contacted by them.

Likewise, users may not use or promote the names or logos of other partner companies, associates or entities that have any commercial or professional relation with “pfplace”.

More specifically and specially the user may not:

-exploit, rent, yield, hire or sell the access to “pfplace” or to its technology.

-decode or attempt to access the engineering or software of “pfplace”.

-copy, file, store, adapt, download, reproduce or distribute in any way the technology of “pfplace”.

-damage the access to the technology of “pfplace”.

-interfere with the security of “pfplace”.  

-remove the copyright or any other sign of ownership of “pfplace”.

11.- “pfplace” Non-responsibility

Any use of the platform of “pfplace” and of its code is the sole responsibility of the user, as well as the use of any software or technology beyond “pfplace”.

It is also the user's sole responsibility the download of any material through “pfplace”.  The user assumes the risk of it. All services and applications that are obtained through “pfplace” are the sole responsibility of the user. “pfplace” is not responsible for the possible damage caused to the components and systems of the user's computer equipment in his or her access to the website of “pfplace” or in the download of any material. “pfplace” will not be responsible either for any damage caused to other type of electronic devices, nor for the loss of data produced during the usage of “pfplace”.

12.- Marketing plan

Everything related with the precise aspects of the promotion by users is specified in the document of Marketing plan.

The Marketing plan may be updated by “pfplace” at any time.

13.- Promoters' ethics

Any user who is a promoter of “pfplace” must accept that:

a)      The user must promote the activity in a correct way without infringing the laws in each case.

b)      Only the user will be responsible for the unlawful practices carried out in the promotion performed.

c)       The user will not transfer obtained data by “pfplace” without previous consent.

d)      The user will remove all data received by “pfplace” if his or her account is blocked or cancelled.

e)      The user will not distort the relation that exists between him or her and “pfplace”.

14.- Relation between “pfplace”  and the user

Between “pfplace” and the user there does not exists any employment relationship.

The registry in “pfplace” will not grant other rights to the user than those listed in this directory of Terms and Conditions.

15.- Sending of information

The user agrees that “pfplace” can send via email, SMS or other media, all type of information or publicity of its advertisers, or other companies, that they see fit.

16.- Transfer of personal information

“pfplace” reserves the right to transfer personal information to a person entitled with whom a commercial agreement is made or that acquires rights to such information as a result of the sale of “pfplace” ,  or substantially of all its assets to such person entitled.

17.- Succession

The user has the right to assign a successor to all rights of his or her registered account in case of death.

In case of a user's death without having assigned a successor, his or her heirs will have the right to acquire his or her registered account, after proving their right according to their national law.

18.- Legal disclaimer

If a third party starts a legal action or lawsuit to “pfplace” for the action of a user, this user must indemnify “pfplace” and must free “pfplace” of all the possible damages, losses and expenses related with such legal action or lawsuit.

19.- Applicable Court of Justice

The jurisdiction of Madrid (Spain) will be the legitimate authority to settle any dispute or conflict that may arise between a user and “pfplace”.
